In these Terms and Conditions, The BikeBoys may be referred to as “the company” or any other term that directly and logically refers back to the The BikeBoys.

The Customer is the buying party who exchanges money for services. The Customer may be referred to as “You” or any other term that directly and logically refers back to the buying party.

 

 

  1. Ordering

1.1       Any contract for the supply of goods from this website is between the customer and the company. The customer agrees to take particular care when providing us with their details and warrant that these details are accurate and complete at the time of ordering.

1.2      The BikeBoys will take all reasonable care, in so far as it is in our power to do so, to keep the details of the customer’s order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss the customer may suffer if a third party procures unauthorized access to any data they provided when accessing or ordering from the website.

1.3      Any order that is placed is subject to product availability and acceptance by us. When the customer places their order online we will send an email to the customer to confirm that we have received it. We will also let you know in this email whether we are able to meet your order. We clearly communicate on our website what the availability of our products is. If we are not able to meet the customer’s order, we’ll do the best we can to find a suitable solution.

1.4      We reserve the right to alter the goods available for sale on the website and to discontinue any product.

1.5      The contract for the goods will become definitive as soon as we have ordered them from our suppliers. We will confirm this to the customer in writing. The customer must inform us immediately if any details are incorrect. If the order has not been accepted, the customer will be notified of this in writing.

 

  1. Prices and Payment

2.1      All prices listed on the website are correct at the time of publication, but we reserve the right to alter these in the future.

2.2      The total price for goods ordered will be displayed on the website when the order is placed. Full payment must be made before goods are delivered.

2.3      The customer must pay for their order before delivery and they can do so by credit card. To ensure that shopping online is secure, your credit card details will be encrypted to prevent the possibility of someone being able to read them as they are sent over the internet. Your credit card company may also do security checks to confirm it is you making the order.

2.4      All prices on our website are including VAT. Except when mentioned otherwise.

2.5      After the payment has been made, the company will provide the customer with the requested service/products. Whenever the company is not able to provide the customer with the requested services, a refund with explanation is given to the customer.

 

  1. Our Website

3.1      The information, content and material available on the website may be updated without prior notification of existing customers. This is in order to ensure that the website is as up to date as possible.
3.2      We aim to have the site available at all times. However, you will appreciate that we cannot guarantee this or that it will be error free and we cannot accept liability for any issues that this may cause.

3.3      Any users of our website are forbidden to interfere with the working of our website and you shouldn’t circumvent with the security on the site, tamper with, or hack into, or otherwise attempt to disrupt our computer system, server, website, router or any other internet connected device or service.

 

  1. Picking up your order

4.1      The company is, together with the customer, responsible for the exchange of goods during the arrival. The customer should go to the designated place to collect his/her bike.

4.2      The company will do anything in their power to provide the customer with the most suitable bicycle.

 

  1. Cancellations

5.1 The customer must notify us immediately if they decide to cancel your order preferably by an email to the info@thebikeboys.nl. The time limit for notification of cancellation is 14 working days. We cannot guarantee that we will be able to stop your order once we receive notice of cancellation as the goods may already have been dispatched.

5.2 Once we have heard from the customer that they wish to cancel their order within the time period we will refund or re-credit their debit or credit card with the full amount within 30 days.

 

  1. Quality & guarantees for faulty goods

6.1 All bikes provided by The BikeBoys are second-hand bikes and are equipped with a bike bell and light. All bikes are checked on safety features before handing out. Safety features include: overall stability, coaster rear brake, light, the tension of the chain and the profile of the tyres.

6.2 Since, the bikes are second-hand, the bikes do not match the attractiveness of a new bike. However, the mechanical quality of the bikes is high.

6.3 When the customer lets us know the bike has a mechanical problem (which is clearly not the customer’s own fault) within 14 days after receiving the bike, we’ll provide the customer with a suitable solution. The bike can be repaired or we provide the customer with an alternative bike.

6.4 After the end of the fourteen-day period we can’t guarantee a new bike or any money in return.

 

  1. Responsibilities

7.1 The BikeBoys will not be held responsible for any loss, indicental or consequential accidents or damage whatsoever caused while our customer used our services.

7.2 When receiving the bike, the customer has time to check the quality of the product. After accepting it, the customer is in full ownership of the bike. The BikeBoys cannot be held responsible for any of their customers actions after delivery.

 

  1. Buy Back procedure

8.1 The BikeBoys are not obliged to buy back the customer’s bicycle, if the bike is bad condition after the exchange period.

8.2 If the company chooses to buy the bike back, the price is generated from the value of the bike. Normally the fixed buy back price for the bike is 50 euro’s. The customer is free to choose whether he/she wants to sell the bike for that price.

8.3 Any money owed by the company to the customers will be transferred online. There will be no cash payments.

8.4 The company won’t buy the provided lock back from the customer.

 

  1. General

9.1 We may alter or vary the Terms and Conditions at any time and any updates will be displayed on the website.

9.2 These Terms and Conditions and our Agreement shall be governed by and construed in accordance with the Dutch laws. The parties hereto submit to the exclusive jurisdiction of the courts of The Netherlands.
